Terms and Conditions
1. General Information
These Terms and Conditions (“Terms”) govern your use of the Viva Ltd meal prep subscription service operated by Viva Ltd, Hawk House, 22 Esplanade, St. Helier, Jersey, JE1 1BR (Jersey Financial Services Commission Registration No. 159627). Throughout these Terms, “we”, “us”, and “our” refer to Viva Ltd. By subscribing to or purchasing our products, you agree to these Terms.
2. Service Description
Viva provides a subscription-based meal prep service with two deliveries per week to customers within Jersey, Channel Islands.
- Each delivery includes freshly prepared meals, labelled with preparation date, use by date, and a link to nutritional and allergen information.
- Meals must be stored chilled immediately upon receipt and consumed by the use by date indicated on the packaging.
3. Subscription Management
- Your subscription will continue indefinitely until paused or cancelled.
- You can pause, cancel, or edit your meal selections at any time, provided changes are made at least 48 hours prior to the next scheduled delivery.
- All changes, including cancellations and pauses, can be managed through your customer login area on https://viva.je.
- If changes are not made within the required notice period (48 hours prior to delivery), you will be charged and the scheduled meals will be delivered as planned.
4. Deliveries and Returns
- Deliveries are included in your subscription fee.
- All glass containers and delivery boxes remain the property of Viva Ltd. We maintain a record of all containers delivered and returned.
- Containers and boxes must be returned clean (dishwasher safe) at the time of your next delivery.
- Failure to return any container or delivery box will result in a penalty charge of £10 per unreturned item.
5. Customer Responsibilities
By subscribing to Viva, you agree to:
- Provide accurate and up-to-date delivery and payment information.
- Ensure someone is available to receive deliveries, or provide clear instructions for safe delivery drop-off.
- Store meals immediately under refrigeration (below 5°C) upon receipt.
- Consume meals before the use by date to ensure food safety.
- Return all containers and boxes cleaned and ready for collection on your next delivery date.
6. Allergies and Dietary Restrictions
While Viva takes every care in meal preparation, meals are produced in a kitchen that handles all major allergens, including but not limited to nuts, sesame, soy, gluten, and dairy.
- Customers are responsible for reviewing all nutritional and allergen information provided via the link included with each delivery.
- Viva does not accept liability for any allergic reactions or intolerances resulting from consumption of meals. If you have a severe allergy, please contact us before subscribing to discuss suitability.
7. Payment and Billing
- By subscribing, you authorise Viva Ltd to charge your chosen payment method for recurring subscription fees.
- All payments are processed securely via CityPay, our third-party payment provider.
- Viva Ltd does not store or process your payment card details directly.
- Payments will be processed in advance of each delivery cycle.
- If payment is unsuccessful, delivery may be suspended until payment is received.
8. Data Protection and Privacy
Viva Ltd is committed to protecting your personal data in accordance with the Data Protection (Jersey) Law 2018.
- We collect and process your personal information (e.g. name, address, contact details, dietary preferences) solely for the purposes of providing our meal prep service, managing your subscription, and complying with legal obligations.
- Payment details are handled securely by CityPay and are not stored on Viva Ltd systems.
- Your data will never be sold to third parties. It may be shared with service providers (e.g. delivery partners, payment processors) only to the extent required to fulfil your orders.
- You have the right to access, correct, or delete your personal data held by us at any time by contacting info@viva.je.

9. Changes to Terms
Viva Ltd reserves the right to amend these Terms at any time. Changes will be posted on https://viva.je. Your continued use of the service after any changes indicates acceptance of the revised Terms.
10. Liability
To the fullest extent permitted by law:
- Viva Ltd accepts no liability for loss or damage arising from your failure to follow food storage, heating, or consumption instructions.
- Viva Ltd is not liable for any indirect or consequential loss or damage.
- Our total liability under these Terms shall not exceed the total fees paid by you in the preceding three months.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Jersey, Channel Islands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jersey.
